Guide to market entry published

Legal firm Charles Russell Speechlys has published a guide to pharmacy market entry in England. It can be accessed here.

“Since 2012, a completely new regime for regulating the grant of new pharmacy contracts in England has been causing confusion among pharmacy owners and would-be pharmacy owners,” says partner David Reissner.

“It is not uncommon in our experience for applications to be refused for reasons that seem highly technical, or for objectors to lose appeal rights because they are not sure where to focus their written representations. This is not altogether surprising. Until 2012 there were 76 regulations. Now there are 121 regulations and there are at least nine different application forms.”

The guide will help pharmacists, including those looking for their first pharmacy, and some with long-established businesses “who may feel like a rabbit caught in car headlights when an envelope from NHS England drops through their letter box, informing them that someone is seeking a pharmacy contract that, if granted, could have a devastating effect on their business,” he says.
